Before booking a tour with Boutique Tours of Wales Ltd, we recommend that you take a few minutes to carefully read over the contents of our terms and conditions and to contact us directly if you have any queries. 

Any amendments to the Terms and Conditions must be agreed with Boutique Tours of Wales directly and confirmed in writing before the booking is completed.  No servant or agent of Boutique Tours of Wales can vary our terms and conditions of booking and any such purported variation shall be of no effect, unless it has been signed by one of the owners or directors.

You as the customer and/or passenger/s and/or client and/or travel agent/operator are referred as to ‘You’ or ‘Your’.  In confirming your tour arrangements and by accessing any part of this Website, ‘You’ shall be deemed to have accepted this notice in full.  When ‘You’ make a booking with Boutique Tours of Wales, ‘You’ are confirming that ‘You’ understand our terms and conditions of booking and carriage and have accepted them on behalf of yourself and all members of ‘Your’ party named within the booking. 

 

Passports, Visas and Immigration Requirements:

Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements and under such circumstances, your cancellation would come under Tour Cancellation terms.

Tour Price:

At the time of booking, we shall confirm the price of the tour based on the number of passengers advised and the duration booked.  The tour prices featured on our web site are lead in prices for low season tours.  Supplementary rates would apply to both mid and high season tours and these rates would be advised at the time of you making your enquiry.  We will endeavour to ensure that the information and prices quoted for your actual tour dates are accurate.  However occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances.  All tours are sold subject to availability and confirmation at the time of making your booking request.

The Contract:

Boutique Tours of Wales cannot be held responsible if any tour date in which you are interested in becomes booked or otherwise unavailable prior to your payment being received. Your tour booking is not confirmed until Boutique Tours of Wales have received your payment and issued your confirmation of booking and receipt of payment regarding the tour arrangements.  All transaction payments are to be in Sterling (British Pounds). Boutique Tours of Wales also reserve the right in our absolute discretion to refuse to accept any booking without specifying a reason. In making your booking you confirm that you have the authority to accept and do accept on behalf of your party, Boutique Tours of Wales terms and conditions.  The person making the booking guarantees payment of the total cost of the booking made on behalf of all individuals and groups to whom the booking applies.  You must check the confirmation of booking carefully and raise any queries immediately upon receipt.  At this point a binding contract will be entered into.

Your Booking:

To confirm your tour booking, we require a deposit of £150 per touring/transfer day, which is non-refundable in the event of your cancellation of our tour services.

Your balance payment is due 85 days* before your tour commencement date.  If you make your booking inside of 12 weeks of your tour date, then the full amount is due payable at the time of booking.  All bookings are confirmed when a non-refundable deposit or full payment is received and we have acknowledged your booking with our written confirmation regarding the tour arrangements.  It is at this stage that a valid contract comes into existence.  Please note that if you do not make all due payments on time, that we are entitled to assume you wish to cancel your booking and keep any deposits.  We also reserve the right to decline any booking.

Payments:

We accept payments by UK Debit Cards, Electronic Bank Transfers (Wire) and by American Express, Mastercard and Visa credit cards. There is no booking fee or charge for card transactions.

Tour Cancellations by Boutique Tours:

Where exceptional circumstances so warrant Boutique Tours of Wales reserve the right (in our absolute discretion) to cancel any tours or services booked.  Where Boutique Tours of Wales have to cancel any private tour arrangements, for whatever reason and where an alternative cannot be offered or taken, there shall be no penalty or administration charge.  In such cases you will be promptly informed and Boutique Tours of Wales will offer a full refund (if applicable) and no compensation, consequential losses or other such claim or liability shall be accepted in the event of such a cancellation by Boutique Tours of Wales.

Cancellation of Private Tours:

In confirming your booking with us, we block out the vehicle from other potential customers using our services.  In the event of you cancelling your tour booking, the deposit paid to secure the tour date/s is non-refundable and not transferable.  Any cancellation notice should be notified to us by email and must quote your name, tour date and booking reference.  The cancellation will become effective from the date received in the office.  Notice of cancellation is deemed to have been received when it is acknowledged by us, either verbally or in writing.  The cancellation policy will not be varied to accommodate clients who cancel tours because of conditions prevailing outside of the UK. Such costs should be recovered from clients’ Travel Insurer.

Cancellation Fees for Private Tours:

Where notification of cancellation has been received by Boutique Tours of Wales then the following cancellation rates are applicable unless prior special individual arrangements have been negotiated and agreed prior to booking:

85 days or more before the tour commencement date – Loss of Deposit.

84 to 57 days before the tour commencement date – 25% Cancellation Fee

56 to 42 days before the tour commencement date – 50% Cancellation Fee

41 to 29 days before the tour commencement date – 75% Cancellation Fee

28 days or less prior to the tour commencement date or on the day the tour commences or during the tour – 100% Cancellation Fee.

Once a tour has commenced, if you choose to cut short the tour or end the tour day early, then this is your own decision howsoever this eventuality may be occasioned, including where you decide to leave or end the tour early and no refund can be made on services that were booked and the proportion of tour not used for that day.  Please note that any payments that we have had to commit and pay in advance on your behalf to secure the tour arrangements, then these amounts will be also deducted from any refund due.

Cancellation of Private Cruise Tours:

We accept that there is a risk to the Captain cancelling docking at a port of call during a cruise.  In confirming your tour booking with us, we block out our tour services and vehicle for your exclusive use.  Naturally, as you have made the commitment to booking and securing your private cruise tour date, we also take our vehicle and services off sale to anyone else and consequently, we turn away many other tour enquiries.  In the event of your port of call being cancelled, we will refund all payments except the non-refundable deposit.

Changing your Tour Arrangements:

If after confirming your private tour booking you wish to change the date or your tour arrangements, we will endeavour to do this for you as long as your proposed changes do not cut into cancellation period.  We cannot guarantee that we will be able to accommodate your changes in dates and any changes will be subject to our availability to accommodate your requests at the time of enquiring.  Providing we can accommodate your proposed changes; we will then charge an amendment fee of £75 per touring/transfer day. 

 

Adding Extra Passengers to the Tour Booking:

The rates quoted are inclusive of the number of passengers booked to tour at the time of making your booking.  In the event that your passenger numbers drop, no discount or refund is applicable to the original tour price paid.  We also reserve the right to charge for any extra passengers who you may invite to join you on your private tour.  This would be subject to our agreement and amended charges which will affect the overall tour booking costs.  We will provide details of the additional charges once you notify us of any additional passengers. Please note that we are licenced and insured to carry a maximum of 7 persons in our vehicle.  Any changes made following the issue of your booking confirmation may be subject to an administration fee of £75, which is at the discretion of the Company. This may also be subject to any extra costs or increased charges incurred or imposed by any of our suppliers involved in operating the tour arrangements. 

 

Changes by us to Sightseeing Tours:

Every care will be exercised in the arrangement of our sightseeing tours. However, we will not be liable for unexpected and unforeseen circumstances beyond our control.  Changes may be made to tours to respond to unexpected and unforeseen circumstances. Your driver has to exercise his/her discretion on the effects which these may have on the tour. If we fail for whatever reason within our control to complete a tour, we will provide suitable alternative transport but our liability shall be limited to the cost of providing transport to the agreed drop off points. We have no liability for any loss, damage, delay, inconvenience or direct or consequential loss.

Liability Waiver (Please read carefully as this is a legally enforceable waiver of rights):

We reserve the right to change, alter or cancel any sightseeing tour arrangement, service or itinerary without notice.  If we are forced to change the tour service, attraction or scheduled event we will try to provide a comparable level of service, attraction or scheduled event.  We have no liability in the event that an attraction is closed or has limited operations on the day of your tour.  These circumstances are outside of our control.  In the event that an advertised place of interest shall be closed or not operating on the day, every endeavour shall be made to substitute with an alternative option.

Shared Tours:

Should we agree to a shared tour with several individual parties sharing the same tour experience, the tours will be offered from the Llandudno and Conwy town areas only.  There will be a scheduled start and end time and all tour participants are expected to be ready at the designated pick up location ten minutes before departure, unless otherwise stated.  These scheduled shared tours work to a set tour itinerary, with no tour deviations allowed.  We expect good and prompt time keeping throughout a shared tour experience. 

Boutique Tours of Wales cannot be held responsible for any passengers who fail to get back to the tour bus in the time allocated for our departure.  Our tours cannot be delayed, as we have a schedule to keep throughout the day and anyone who is left behind for being late, will have to make their own way back to their accommodation.  As a result, we will not be held liable for a delay caused by lateness and neither will you be entitled to a refund in the event of this occurring.

General Conditions:

All bookings are accepted on the basis that the agreed number of passengers complies with our licensed capacity for the vehicle.  The lead person responsible for making the booking is responsible for all the passengers who are booked on the tour.  They will be responsible for their conduct and for any damage caused to the vehicle during the tour.

Any special arrangements and requests must be made at the time of making your tour enquiry.  Subject to our agreement, any special agreements will be confirmed in writing and listed on the confirmation of booking.. 

We reserve the right to make use of a substitute vehicle or variety of vehicles and to sub-contract to another company/driver. 

Drivers’ Hours and Rest Period Regulations.

The hours agreed with the operator for the operation of any hire must be strictly observed (other than in the case of serious emergency or diversion) so that regulations governing drivers’ hours and rest periods can be complied with. Boutique Tours of Wales reserves the right to curtail or otherwise alter any hire which does not comply with the relevant regulations.

Conduct of Passengers:

Every passenger in a vehicle must have their own seat. Seats cannot be reserved.  You agree that all passengers will wear seat belts correctly whilst the vehicle is in motion.  You must inform the driver immediately if any of the seat belts in the vehicle are missing or not functioning correctly.  No liability is accepted for loss or damage suffered as a result of the non or misuse of seat belts.  

We operate a strict no smoking policy (including e-cigarettes) in our vehicle and the immediate vicinity around the vehicle.  We do however make frequent stops during the touring day, where you may wish to get out and smoke during the course of a tour stop

For your own safety, passengers must not distract the driver whilst the vehicle is in motion. The driver is responsible for the safety of the vehicle. Any passengers whose conduct is in breach of statutory regulations may be removed from the vehicle or be prevented from boarding on the driver’s authority.

Disabilities and Medical Conditions:

Unfortunately, our tour vehicles are not wheel chair accessible.  We will try to accommodate anyone with disabilities and medical conditions where we can but please be aware that many of our tours may not be suitable. We can carry folding wheelchairs and we can also carry small/ lightweight folding mobility scooters and walkers. 

You should be aware that there is a step up from the outside ground of 20 inches to the inside floor of the vehicle.  For your convenience, to help break the distance from the ground into the vehicle, we carry a portable step, which is 10 inches from the ground, and if needed, a wooden block, which breaks your step off the ground at 4 inches.  There are also grab handles to assist.

If you or any member of your party has any disability or medical conditions which may affect their ability to travel in our tour vehicle, then please provide us with full details at the time of making your tour enquiry, We can then advise you as to the suitability of your chosen arrangements. 

If we are not informed of any disabilities or medical condition, then we cannot be held responsible or liable for any cost or inconvenience incurred if we are unable to accommodate you or any member of your party on a tour.

Carriage of Children:

We accept family bookings with young children on private tours only and the following terms are applicable to the carriage of children who are under the age of 14.  No discount is offered for children and all children must be accompanied by an adult.

If you turn up for a shared tour with children under the age of 14, you will be refused the right to board the touring vehicle and we have the right to terminate your tour booking without refund.

In line with UK Law, private hire vehicles do not have to provide child car seats & children can travel without one but only if they travel on a rear seat. Legally the parent/guardian is liable for the child’s safety however we do deem it unsafe to take under 4-year olds without a child seat.  We reserve the right to cancel a tour if you refuse to seat a child under 4 years of age in a child seat. Child seats can be hired from us, but must be booked and paid for in advance of the tour. 

 

Consumption of Alcohol, Food and Refreshments in the Tour Vehicle:

Alcohol is not allowed on any vehicle as laid down in the Sporting Events Act 1985 and anyone not complying will be required to vacate the tour vehicle.  We reserve the right to refuse a reservation or cancel or decline a booking if you or any of the passengers are abusive, are thought to be under the influence of alcohol or illegal drugs or are otherwise considered by us to represent a risk to the driver, the vehicle or affects the enjoyment of the tour by other passengers or road users.  Should any of the above situations occur, no refund will be given for unused services to anyone who is asked to leave the tour and you will not be entitled to any refund or compensation and we shall be under no further obligation or liability to you.   In the event that we cancel or decline a booking in accordance with the condition above, you remain liable to pay the entirety of the agreed hire charge, including any additional charges incurred.

As our vehicle is in constant use, refreshments (drinks other than bottled water) and food may not be consumed in the vehicle. 

Carriage of Animals:

We don’t allow the carriage of any animals on our tour or transfer operations, other than guide dogs or hearing dogs, which must be notified to us at the time of booking.

Tour Accommodation and Third-Party Options:

Generally, our tour rates do not include any accommodation.  We can, however, assist you with suggestions of where to stay during the course of a tour with us.  We can even help make your reservation on your behalf.  Whilst we make suggestions for your accommodation, we have no control over the operation of the chosen property. 

In booking accommodation or any other services through us, you enter into a direct contractual relationship with the relevant third-party provider and we act solely as an intermediary, transmitting the details of your reservation to the relevant accommodation (or other service) provider. You will pay the accommodation or third-party provider directly.  Each provider will have their own terms and condition of booking and in the event of any cancellation of the tour arrangements, you will be liable for any cancellation charges that they raise.  In booking accommodation for your tour, we are not liable for any accidents, damages or loss to with these third parties.  If you choose to book your own tour accommodation, we will need to be provided with the name, number of the house along with the full address and contact names and telephone numbers of the proprietors.  If your accommodation choice is in a remote area, then you should also provide us with accurate directions to assist our delivery of you to your accommodation. 

We include a number of visits to a variety of attractions as part of our tours.  However, all attractions are operated by third parties, which are outside of our control. Therefore, we are not liable for any damages, loss or closures to do with these third parties.  We do not include any entrance fees to any tourist attractions or include tickets for railway journeys or include any meals, refreshments in the cost of the tour. We will upon request advise you on the approximate costs.

Disclaimer:

Boutique Tours of Wales Ltd cannot be held responsible for any accidental injury/damage that may occur in your choice to visit tourist attractions, stopping to take photographs, or take up the challenge of any of the walks whilst away from the vehicle. These are undertaken at your own request. Visiting medieval castles and town walls often means walking on uneven and slippery surfaces. Climbing Castle towers by stone staircases are often circular steep and narrow steps.  Castle walls are undulating with uneven surfaces. Know your capabilities and don’t overstretch yourself with the walk/s. Know what you are liable to expect on the walk. Check you are properly equipped for the walk with footwear and clothing. Take a sensible approach to the weather. Be constantly aware of any natural hazards whilst out and about from the vehicle.  You agree to comply with the laws and regulations of the country visited on the trip and to comply with all reasonable instructions of the trip leader relating to safety and organisation of the trip.

Personal Travel Insurance:

Personal insurance is not included in our tour rates.  All passengers are advised to obtain personal travel insurance cover.  For your own protection your insurance should be valid from the time that you make your booking.  You must be satisfied that your insurance fully covers all your personal requirements.  We also suggest that you carry the policy details on tour with you and in particular you should take note of the emergency medical and repatriation telephone numbers and carry this information on you at all times when you travel.  You are responsible for indemnifying us in full in the event that we incur any losses or expenses arising out of your failure to take out adequate insurance cover. If you choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.

Personal Luggage and Effects:

All vehicles in the UK are governed by weight restrictions/limits.  Due to these restrictions, each person is permitted to carry in the vehicle one small bag each.  Passengers are responsible for their own luggage and all their own personal effects at all times whilst at the pick-up point, at the stops and in the vehicle.  You are expected to be able to handle and lift your own luggage, as you may have to carry your bag to and from your accommodation, pick-up/drop off locations such as airports and railway stations.

We will not be liable for any loss or damage to luggage or its contents or personal effects resulting from carrying or leaving any luggage or personal effects in our vehicles.  We accept no liability for damage to or loss of (whether by theft or otherwise) your luggage or personal belongings.  If you or any of your party deposit personal possessions, with an employee or a third party on any of the attractions, restaurants, etc that we visit, then they do so at their own risk and we will not be responsible for any loss or damage to these items however caused.

Liability for Loss and Damage:

The client agrees to indemnify Boutique Tours of Wales Ltd in respect of any accident, personal injury, loss of life or damage to property caused by the client during the course of the trip.  We have no liability for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our employees’ negligence, in which case our liability is limited to a maximum of the refund of the tour cost.  We shall not be liable for any loss, consequential loss, inconvenience or delay arising out of the breakdown or failure of any vehicles or from circumstances beyond our control.  We accept no liability for bodily injury, sickness or death save where the same is caused as a result of our negligence.  We accept no liability for any losses suffered by you as a result of delay.

Route Travelled and Delays:

Please be aware that the nature of travel and touring involves risks and unpredictable weather and road conditions and we therefore cannot guarantee any departure or arrival times at any particular points of a tour itinerary.  In determining the tour and transfer routes, we shall take account of the traffic conditions, road works, weather and such other matters that we determine to be relevant.  We do not guarantee the completion of any journey in a specific timeframe.  No responsibility is accepted for delays caused by circumstances beyond our reasonable control. It is accepted that we will not be liable for compensation due to a missed train, ferry, flight or cruise ship departure. Without prejudice to the generality of the above conditions, we shall not be liable for delays caused by: adverse weather conditions, strike action, abnormal traffic volume, vehicle breakdowns, accidents, flight delays, acts of god, civil conflict, war or force majeure.

Time Variation:

If you request extensions to your touring day or should our vehicle be detained by you or taken on a longer journey than you contracted for, we reserve the right to make an additional charge of £60.00 per hour.

Drop Off & Pickup:

We deliver a meet & greet service at all airports, ports and railway stations at the start and end of tours. Our driver/guide will wait at an agreed location confirmed to you in our joining instructions and will be identified by a ‘Boutique Tours of Wales sign. 

Drop off & Pick up charges are included in your transfer price.  For your accommodation drop off and pick up arrangements, we shall endeavour to park as close as possible to the front door of the property.  We cannot be held liable if we are unable to reach the front door of a property and we also have to abide by the local traffic and parking laws, in particular with relation to enforcement cameras, which may restrict our access or route to the said property.

Delays on Arrival:

We monitor your flight/ferry for our ‘Meet and Greet’ arrangements via mobile apps/airline /ferry sites or the airport/ferry terminal website. 

In terms of meeting you at an airport, we have to wait off site until your aircraft has landed.  We normally come into the terminal 30 minutes after your arrival and we can be easily identified with our hand-held signs.  We will agree a convenient meeting place that helps make us easily identified.

If your flight arrives early, we cannot guarantee to be there until the original scheduled arrival time.   If this occurs, we kindly ask you to SMS text message, email, Whats App Message or call us.  We can provide you an estimated ETA based on the original schedule agreed.  In the meantime, you can take a seat in the arrivals hall and we will contact you when we approach the terminal.

If your flight/ferry is delayed, please contact us with your new estimated time of arrival.  Our driver will wait up to an hour after the scheduled time of your aircraft/ferry arriving, after this waiting time is charged at £60.00 per hour. Our driver-guide will wait up to 3 hours and then if you have failed to appear, we will return to our base and you will be counted as a no-show.

If your inbound flight is delayed over 8 hours, cancelled or redirected to another airport, or fails to make your connection between flights en route to our pick up location, our services will be deemed as cancelled for the day with cancellation terms applying.  We can re-route to an alternative rendezvous pick-up location for an agreed supplement, otherwise we will agree that you make your way to a rearranged meet up location.

If you do not arrive on the flight that you stated, no refund will be given for this day. Additional charges may also be payable if we have not been informed of your change in travel arrangements/ or you have failed to update us with your change in flights schedules.

Damage/Soiling of Vehicle:

In the event that our vehicle is soiled and / or damaged by you, you will be liable to reimburse to us all costs reasonably incurred by us in cleaning the vehicle and / or having the vehicle repaired.  You will also be liable to pay to us the sum of £500 for each day or part thereof that the vehicle is unable to be used for our business whilst it is being repaired and / or cleaned.

Complaints:

We do take pride in the quality, comfort and cleanliness of our vehicle.  If you have cause for any complaint, then please bring the matter to the immediate attention of the driver.  Any complaint should, in the first instance be communicated to the driver. Should the matter remain unresolved then passengers must report the matter to Boutique Tours of Wales Ltd without delay with confirmation in writing not later than 7 days from the return of the tour.  It is our policy not to provide any discount, reimbursement or financial compensation whatsoever in the event of the vehicle falling below the standards of comfort that you might expect, including (but not limited to) failure with the vehicles heating system, air conditioning, climate control systems, windows, doors, fridges or entertainment devices.

Where our websites contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or of any information you may obtain from them. You must not establish any link to our websites unless we have given our express written approval of this.

Images and Videos:

You consent to us using any images and videos taken of you during the tour for advertising and promotional purposes in any medium that we choose to promote our services through.  Any testimonials, photographs or content which you upload to our websites or social media channels will be considered non-confidential and non-proprietary, unless expressly stated by you in writing to Boutique Tours of Wales Ltd.  You retain all of your ownership rights in your content, but you are required to grant us a licence to use, store and copy that content and to distribute and make it available to third parties. Uploading your content shall automatically grant us a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, distribute and display such content for such purposes as we may reasonably require including, without limitation, for use in our marketing materials and publicity.

Governing Law:

This Agreement is governed by the law of England and Wales. All disputes shall be submitted to the sole jurisdiction of the English Courts.  By making a booking with us, you agree to be bound by our Terms and Conditions.
